The fssai refers to the Food Safety and Standards Authority of India, which is an authority that oversees and regulates the food industry in India. It is an independent organization founded by the Indian government’s Ministry of Health & Family Welfare.

Penalty for not getting fssai license

  • The owner of the food establishment may be fined up to Rs. 5 lakhs and imprisoned for violating the FSSAI licence.
  • Anybody who sells misbranded goods is subject to a fine of up to Rs. 3 lakhs.
  • The owner of a food business may be charged up to Rs. 5 lakhs if they sell food items of poor quality. 
  • The FSSAI fine for such food enterprises is up to Rs. 1 lakh if a person selling, storing, distributing, or importing food goods for human use is discovered to have any extraneous or redundant material.
  • Anybody who produces or processes food items intended for human consumption in unclean, hazardous, or unhygienic conditions would be subject to a fine of Rs. 1 lakh. 
  • Depending on the severity of the harm or injury caused by the dangerous food goods, compensations of up to 5 lakhs are given in cases where a consumer may die after consuming low-quality food.

Types of food licenses in India

FSSAI registration is determined based on business categories, revenue, and production capacity.

  • FSSAI Basic Registration – FBOs that make less than Rs. 12 lahks annually must register with the FSSAI. Form A is the FSSAI registration form the applicant must complete to receive FSSAI basic registration.
  • FSSAI State License – FBOs must seek a state license from the FSSAI if their annual revenue exceeds Rs. 12 lahks but falls below Rs. 20 crores. Form B is the FSSAI registration form the applicant must complete to get an FSSAI state license.
  • FSSAI Central License – FBOs must obtain an FSSAI central licence if their annual revenue exceeds Rs. 20 crores. Form B is the FSSAI registration form the applicant must complete receiving an FSSAI central licence.

Eligibility for fssai license

  • Any FBO having maximum annual revenue of Rs. 12 lahks.
  • Small-time food product retailer.
  • Anybody who produces or sells food products on their own.
  • The temporary stall holder that sells food.
  • Any person, excluding a caterer, who distributes food during a religious or social event.
  • Cottage or small-scale businesses engaged in the food industry.

FSSAI registration procedure

Step 1

Fill out Form A on the FSSAI website for licence registration and pay at an FBO nearby to submit your application for FSSAI.

Step 2

You must submit Form B to the government once the payment confirmation appears in your FSSAI account. Several declarations and resolutions must be submitted along with your application, such as a board decision or an owner self-declaration. Ideally, a corporate secretary should prepare these declarations.

Step 3

Then, it would help if you connect with the government department again to determine how your application is progressing. If you don’t react within 15 days of receiving the application, the government may send it back for revisions, and your application may be denied.

Step 4

The government department will thoroughly review and approve your application in 45–60 working days. In rare circumstances, the customer might need to go to the food department or pay the inspector additional fees.

Documents required for fssai registration

  • Business-Related Premises Rental Agreement.
  • The concerned person’s identification document, such as an Aadhaar card, a driver’s license, a passport, or a voter ID
  • Any applicable Government Registration Certificates, such as a Business Incorporation Certificate, Partnership Deed, Firm Registration Certificate, Pan Card, Shop and Establishment Registration Certificate, GST Registration Number, or Trade License
  • If the applicant is a partnership firm or private limited company, they must present a copy of the MOA & AOA or the partnership deed.
  • One of the following certificates, such as a trade license, shop and establishment registration, panchayath license, corporation license, or municipal license, is required to apply for a state license.

Fssai license renewal

Before the license’s validity period expires, you must renew your FSSAI licence. A minimum of 120 days and a maximum of 30 days before the license’s expiration date must pass before the renewal application is due. If you cannot renew your application on time, you must reapply for an FSSAI licence to continue operating your food business.
